Employment tribunal compensation explained

Employment tribunal compensation varies significantly depending on the type of claim, your financial losses, and the circumstances of your case. Here is what the tribunal can award.

Basic award

Calculated the same way as statutory redundancy pay. Based on age, length of service, and weekly pay (capped at £700). Maximum basic award is £21,000 for 2024/25.

Compensatory award

Intended to compensate you for financial losses caused by the dismissal. Includes loss of earnings, loss of benefits, loss of pension rights, and expenses. The compensatory award is capped at the lower of £115,115 or 52 weeks' gross pay (the cap does not apply to discrimination claims).

Injury to feelings (discrimination claims)

For discrimination claims, the tribunal can award compensation for injury to feelings using the Vento bands: lower band £1,100–£11,200, middle band £11,200–£33,700, upper band £33,700–£56,200. The most exceptional cases can exceed the upper band.
